These Terms of Service govern your use of this website and any SEO consulting services provided by Anindya Chandra Dey, trading as Anindya Growth (“Anindya Growth,” “I,” “me,” or “my”).

By using this website, contacting me, requesting a review, booking a call, or purchasing services, you agree to these Terms.

If we agree separate written terms in a proposal, invoice, contract, statement of work, or email, those project-specific terms will apply to that engagement. If there is a conflict, the more specific written project agreement will control.

1. Services

I provide technical SEO consulting services for ecommerce websites, especially Shopify and WooCommerce stores.

Services may include:

  • Technical SEO audits
  • Monthly SEO retainers
  • Focused technical SEO fix sprints
  • Indexing recovery support
  • Core Web Vitals support
  • Migration SEO support
  • Website architecture reviews
  • Crawlability and indexability analysis
  • Technical SEO implementation guidance
  • SEO consulting and advisory support

The exact scope, deliverables, timeline, fees, and payment terms for paid work will be agreed separately in writing.

2. Free reviews and discovery calls

I may offer a free website review or discovery call.

A free review is a preliminary assessment based on limited information. It is not a full SEO audit, does not include complete diagnosis of every issue, and does not guarantee any SEO outcome.

I may decline a free review or project request if I believe the project is not a good fit.

3. Website information

The content on this website is provided for general informational purposes only.

Website content, articles, case studies, service descriptions, and examples are not legal, financial, business, or guaranteed SEO advice.

I make reasonable efforts to keep website information accurate, but I do not guarantee that all content is complete, current, or error-free.

4. No guaranteed SEO results

SEO results depend on many factors outside my control, including:

  • Search engine algorithm changes
  • Website implementation
  • Developer availability
  • Platform limitations
  • Competition
  • Content quality
  • Backlink profile
  • Brand authority
  • Site history
  • Tracking accuracy
  • Product-market fit
  • Business decisions
  • Third-party tools, apps, plugins, or hosting

I do not guarantee specific rankings, traffic levels, revenue increases, conversions, indexing outcomes, Core Web Vitals scores, or search engine performance.

Case studies and examples shown on this website are for illustration only. They do not guarantee the same or similar results for your business.

5. Client responsibilities

To complete SEO work effectively, you agree to provide accurate and timely information, access, feedback, and approvals when needed.

This may include access to:

  • Website CMS or ecommerce platform
  • Shopify, WooCommerce, or WordPress
  • Google Search Console
  • Google Analytics
  • Google Tag Manager
  • Page speed tools
  • Crawling tools
  • Theme, staging, or development environments
  • Relevant plugins, apps, or technical documentation
  • Hosting, CDN, or DNS information where necessary
  • Project management or communication tools

You are responsible for ensuring that you have permission to grant access to these tools and websites.

You are also responsible for reviewing recommendations before implementation, especially where changes may affect design, development, tracking, legal compliance, user experience, revenue, or business operations.

6. Access credentials and security

You should avoid sending passwords directly by email where possible.

Where available, use secure access-sharing methods, limited permissions, collaborator access, user roles, password managers, or temporary access.

You are responsible for removing or revoking my access after a project ends if access is no longer needed.

I am not responsible for issues caused by access delays, incorrect permissions, expired access, third-party account restrictions, or access removal before work is complete.

7. Implementation

Some services may include recommendations only. Other services may include direct implementation, implementation support, or collaboration with your developer.

Where implementation is included, I will take reasonable care when making or recommending changes. However, websites can behave differently depending on themes, plugins, apps, hosting, custom code, third-party scripts, and platform limitations.

You are responsible for maintaining backups, staging environments, developer support, QA processes, and internal approvals where needed.

I am not responsible for issues caused by missing backups, untested third-party code, theme conflicts, plugin conflicts, app conflicts, hosting issues, platform bugs, or changes made by other parties.

8. Timelines

Estimated timelines are based on the agreed scope and the information available at the start of the project.

Timelines may change if:

  • Required access is delayed
  • Information is incomplete
  • Scope changes
  • Client feedback or approval is delayed
  • Third-party tools or platforms have issues
  • Developers or other collaborators are unavailable
  • Additional technical issues are discovered
  • Payment is delayed

Unless otherwise agreed, project timelines begin after payment, required access, and necessary project information have been received.

9. Scope changes

The agreed service includes only the scope confirmed in writing.

Additional requests, new issues, extra pages, new templates, additional calls, implementation beyond the agreed scope, or major project changes may require a separate quote, additional fee, or revised timeline.

10. Fees and payment

Fees will be agreed before paid work begins.

Payment terms may vary by project and will be stated in the proposal, invoice, written agreement, or email confirmation.

Unless otherwise agreed:

  • Audit and sprint projects may require upfront payment.
  • Monthly retainers are billed monthly.
  • Work may pause if payment is late.
  • Fees are stated in USD unless otherwise specified.
  • Client is responsible for any bank fees, transfer fees, currency conversion fees, taxes, or payment processor fees that apply.

I may change website pricing or service descriptions at any time. Pricing changes do not affect already agreed paid engagements unless separately agreed.

11. Refunds and cancellations

Due to the nature of consulting, analysis, strategy, and digital services, payments are generally non-refundable once work has started.

If you need to cancel or pause a project, contact me as soon as possible. Any refund, credit, or partial billing adjustment will depend on:

  • Work already completed
  • Time reserved
  • Deliverables prepared
  • Access or onboarding already completed
  • The agreed terms for that project

For monthly retainers, either party may end the engagement according to the notice period agreed in writing.

If no separate notice period is agreed, either party may end a monthly retainer by giving written notice before the next billing cycle.

12. Late payments

If payment is late, I may pause work, delay deliverables, withhold final files, or stop providing services until payment is received.

You remain responsible for amounts already due for work completed, time reserved, or services provided.

13. Communication

I primarily communicate by email, Loom, project management tools, shared documents, and scheduled calls.

I aim to respond within 2 business days, often faster. Response times may vary due to weekends, holidays, workload, time zones, project complexity, or urgent deadlines.

Unless separately agreed, ongoing real-time availability, emergency support, or same-day response is not included.

14. Client content and business responsibility

You are responsible for your website, products, services, claims, pricing, content, policies, legal compliance, and business operations.

You are responsible for ensuring that your website content, product claims, privacy notices, cookie notices, terms, refund policies, and marketing comply with laws that apply to your business.

I may provide SEO recommendations, but I do not provide legal, tax, financial, medical, regulatory, or compliance advice.

15. Personal data and privacy

If you provide access to tools or data containing personal information, you confirm that you have the right to share that information with me for the purpose of receiving SEO services.

You should avoid sharing unnecessary personal information. Aggregated, anonymized, or limited-access data is preferred when it is enough for the project.

If a project requires me to process personal data on your behalf in a way that requires a separate data processing agreement, we can agree that separately in writing.

My handling of personal information collected through this website is described in the Privacy Policy.

16. Confidentiality

Both parties agree to keep confidential information private and not disclose it to third parties unless necessary to complete the project, comply with law, enforce rights, or with prior permission.

Confidential information may include:

  • Website access
  • Analytics data
  • Search Console data
  • Revenue or traffic information
  • Business strategy
  • Technical documentation
  • Private communications
  • Project files
  • Internal processes
  • Non-public business information

Confidentiality does not apply to information that is publicly available, already known before disclosure, independently developed, or lawfully received from another source.

17. Intellectual property

Unless otherwise agreed, you retain ownership of your website, business assets, branding, data, content, and internal materials.

I retain ownership of my pre-existing templates, processes, frameworks, checklists, methods, systems, documents, know-how, and internal working materials.

Once full payment is received, you may use final deliverables created specifically for your project for your own business purposes.

You may not resell, redistribute, publish, license, package, or present my deliverables, templates, systems, or methods as your own service or product without written permission.

18. Portfolio, testimonials, and case studies

I may ask for permission to use your name, logo, testimonial, or project results in my portfolio, case studies, or marketing materials.

I will not publish confidential project details without permission.

If a case study is anonymized, I may describe the work and results without identifying your business.

19. Third-party tools and platforms

SEO work may involve third-party tools and platforms, including but not limited to Shopify, WooCommerce, WordPress, Google Search Console, Google Analytics, Google Tag Manager, hosting providers, CDN providers, page speed tools, crawling tools, plugins, apps, payment processors, and project management tools.

I am not responsible for outages, bugs, errors, policy changes, pricing changes, account restrictions, data loss, inaccurate reports, or issues caused by third-party tools or platforms.

20. Website use

You agree not to misuse this website, including by:

  • Attempting to hack, disrupt, damage, or overload the website
  • Submitting spam, malware, or malicious content
  • Scraping, copying, or republishing website content without permission
  • Using the website for unlawful purposes
  • Attempting to gain unauthorized access to systems, accounts, or data

I may restrict access to this website if I believe there is misuse, abuse, spam, or a security risk.

21. Disclaimer of warranties

This website and services are provided on an “as available” and “as agreed” basis.

To the fullest extent permitted by law, I disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, error-free operation, and guaranteed SEO performance.

Nothing in these Terms limits rights that cannot be excluded under applicable law.

22. Limitation of liability

To the fullest extent permitted by law, I will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of revenue, profits, traffic, rankings, data, goodwill, business opportunities, or business interruption.

My total liability for any claim related to a paid service is limited to the amount you paid for the specific service giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

23. Indemnification

You agree to indemnify and hold harmless Anindya Growth and Anindya Chandra Dey from claims, damages, losses, liabilities, costs, or expenses arising from:

  • Your website or business
  • Your products or services
  • Your content, claims, policies, or legal compliance
  • Your misuse of this website or services
  • Your violation of these Terms
  • Your violation of laws or third-party rights
  • Information, access, materials, or instructions you provide
  • Changes made by you, your team, your developer, or third parties

24. Force majeure

I am not responsible for delays or failure to perform caused by events outside my reasonable control, including internet outages, platform outages, hosting issues, payment processor issues, illness, natural disasters, war, civil unrest, labor disputes, government actions, power failures, or third-party service disruptions.

25. Termination

Either party may terminate a service engagement according to the terms agreed in writing.

I may stop providing services if:

  • Payment is late
  • Required access or information is not provided
  • The scope becomes materially different from what was agreed
  • Communication becomes abusive, unlawful, or unreasonable
  • Continuing the project would create legal, ethical, technical, or security concerns

Termination does not remove your responsibility to pay for work already completed, time reserved, or amounts already due.

26. Governing law

These Terms are governed by the laws of Bangladesh, unless a separate written agreement states otherwise.

For international client engagements, project-specific agreements may include separate governing law, jurisdiction, or dispute resolution terms.

27. Changes to these Terms

I may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date.

Your continued use of this website after changes are posted means the updated Terms apply from that date forward.
